Terms and Conditions
These Terms and Conditions (the “Terms”) set forth the basis on which WOTELS (as defined below) will provide lodging and other products and services at its properties to Customers (as defined below) and Guests (as defined below). By making a Reservation (as defined below), the Customer represents that they have read, understood, and accepted these Terms.
(1) Interpretation
In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:
“Arrival Date” means the date on which the Customer’s stay at the Properties is scheduled to begin, as indicated in the Reservation Details.
“Reservation” means the reservation made by the Customer for accommodations and any other products and services detailed in the Reservation and accepted by WOTELS.
“Reservation Details” means the details of the Reservation, including the number of Guests, the number of rooms required, the length of the Guests’ stay at the Properties, and any other products and/or services included in the Reservation.
“Fees” means the amounts payable by the Customer in connection with the Reservation.
“Contract” means the contract entered into between the Customer and WOTELS regarding the Reservation.
"Customer" means the person who makes the Reservation.
“Guests” means the Customer and any third parties included in the Reservation or invited by the Customer to the Properties in connection with the Reservation.
“Properties” means the properties owned or operated by WOTELS, the locations of which are specified in the Reservation.
(2) Reservations and Accommodation Policies
(2.1) The Reservation will not be considered confirmed until it has been accepted by WOTELS and, where applicable, until the amounts required at the time of the Reservation have been paid.
(2.2) The Customer is responsible for ensuring that the Reservation Details provided to WOTELS are complete and accurate, including the number of Guests, dates of stay, and any other information relevant to the Reservation.
(2.3) The Customer is responsible for ensuring that all Guests included in the Reservation comply with these Terms and Conditions.
(2.4) Minors who are not accompanied by a parent or legal guardian are not permitted to make reservations or enter the premises. When a minor is accompanied by an adult who is not a parent or legal guardian, valid authorization from the respective parent(s) or legal guardian must be presented, whenever applicable.
(2.5) WOTELS reserves the right to request identification documents from Guests for the purpose of verifying their identity, complying with applicable legal obligations, and completing check-in procedures.
(2.6) WOTELS may establish specific booking conditions, rates, cancellation policies, or other terms applicable to certain rates, periods, Properties, or promotional offers. Where applicable, these conditions will be presented to the Customer at the time of the Reservation and will take precedence over these Terms and Conditions to the extent that they are more specific.
(3) Fees and payment
(3.1) The Fees shall be those indicated by WOTELS to the Customer at the time of the Reservation or upon request for a Reservation, unless specific conditions apply pursuant to Section 2.6.
(3.2) Unless otherwise agreed by WOTELS, the Fees cover only the provision of lodging at the Properties. The Customer may incur additional costs, including, without limitation, costs for meals, beverages, services, consumables, or other products and services available at the Properties (the “Additional Costs”).
(3.3) Whenever applicable, Customers will be informed of the amount of the Additional Costs before they are incurred.
(3.4) Surcharges may apply for additional guests, depending on their age and the terms and conditions applicable to the respective Property:
For guests up to 12 years old:
- 30 € for WOT Ericeira, WOT Lagos, and WOT Costa da Caparica;
- 15 € at the other properties.
For children up to 5 years old, a 50% discount applies, provided it is specified in the reservation.
For children ages 0 to 2, accommodations are free when included in the reservation.
The specific terms and conditions applicable to each reservation will be displayed at the time of booking.
(3.5) Reservations shall be subject to one of the following conditions, as applicable:
a) full payment of the fees in advance; or
b) payment of a reservation fee and/or deposit; and/or
(c) providing valid debit or credit card information through which the Fees, the balance of the Fees, and/or any Additional Costs may be charged, in accordance with the terms applicable to the Reservation.
(3.6) If the reservation has not been paid in full in advance, the Customer must pay the balance of the charges at the time of check-in at the Properties, unless otherwise specified or agreed. Any Additional Costs must be paid as they are incurred or, at WOTELS’ discretion, at check-out.
(3.7) Payment Methods
(3.7.1) WOTELS accepts the following payment methods:
a) credit and debit cards, including Visa, MasterCard, and Maestro;
(b) cash, under the conditions set forth in section 3.7.2.
(3.7.2) Cash Payment
WOTELS follows a largely cashless policy, based on the safety of its employees and the prevention of risks associated with the handling and safekeeping of cash at its locations. Notwithstanding this policy, WOTELS recognizes that euro bills and coins are legal tender and that consumers have the right to use them; therefore, it ensures that cash payments will be accepted whenever a consumer does not have an alternative means of payment.
(4) Cancellations and Changes
(4.1) The cancellation and change policies applicable to the Reservation shall be those presented to the Customer at the time of the Reservation.
(4.2) Whenever a Reservation is subject to a nonrefundable rate or specific cancellation terms, these will be communicated to the Customer at the time of the Reservation.
(4.3) Failure to comply with the applicable payment or cancellation terms may result in the charges specified in the booking terms.
(5) Check-in and check-out
(5.1) The Customer and Guests must comply with the check-in and check-out times set by the respective Property.
(5.2) Early check-in or check-out after the established time is subject to the Property’s availability and may incur additional charges.
(5.3) WOTELS may request a valid form of identification at check-in, in accordance with applicable procedures.
(6) Responsibilities of Customers and Guests
(6.1) The Customer and Guests must use the facilities, equipment, and services of the Properties responsibly and in accordance with applicable law, these Terms and Conditions, and any specific rules of the respective Property.
(6.2) The Customer shall be liable for any damage caused by the Customer or by Guests to WOTELS’ facilities, equipment, furniture, or other property, except when such damage results from normal wear and tear or from circumstances not attributable to them.
(6.3) WOTELS may charge the Customer reasonable costs associated with the repair or replacement of damaged property when the damage is attributable to the Customer or the Guests.
(6.4) The Customer and Guests must respect other guests, employees, and the operating rules of the Properties.
(7) Personal belongings
(7.1) The Guest and Visitors are responsible for their personal belongings during their stay.
(7.2) WOTELS shall not be liable for the loss, theft, or damage of personal property belonging to Customers or Guests, except where such liability is mandated by applicable law.
(7.3) Customers and Guests must use the security measures provided by the respective Property, when available.
(8) General Terms and Conditions
(8.1) WOTELS reserves the right to amend these Terms and Conditions whenever necessary; the version in effect at the time the reservation is made shall apply to that reservation, unless otherwise required by law.
(8.2) If any provision of these Terms is found to be invalid, illegal, or unenforceable, in whole or in part, this shall not affect the validity of the remaining provisions.
(8.3) These Terms and Conditions are governed by Portuguese law.
(8.4) Any dispute arising from the interpretation or enforcement of these Terms and Conditions shall be resolved in accordance with Portuguese law and by the competent courts, without prejudice to the rights legally granted to consumers, including the applicable alternative dispute resolution mechanisms.
